This legal argument has been going on since the dark ages of climbing. Land owners in the UK tried to ban climbing on crags situated on their land on the basis they could be sued for any injuries incurred by falling climbers.

Climbers appealed against the bans and won - not sure about the exact wording but it was along the lines that the owners of crags (usually public authorities) do not assume a duty of care to climbers or any other users of the cliffs. Sort of along the lines of tim's voluntary assumption of risk.

I agree with Tim, if a climber plopped off the wall from a broken hold and was injured then he or she is in no different position to someone falling off a broken hold at Arapiles. However, if he then decked a cyclist who then roled into the Yarra and drowned - then the subsequent court battle between the distressed cyclists family, the climber and Citilink would make interesting reading.
