Workcover would have nothing to do with incidents such as these. As I understand they only involve themselves where there is an incident involving unsafe work practices that would effect employees and this doesn't extend to paying punters. In cases of pilot error (in an ideal world) climbing gyms should not fear litigation as these incidents do not stem from some failing on the gyms part (unless it is a supervision/instructional f--- up). Unfortunately, there will always be someone looking to find blame outside of themselves, and for them, Courts often give sympathy and look past the gym to the big, wealthy insurance company behind them.
