This suit is a side effect of the freedom to lodge a civil suit. It would not enhance our liberty to restrict the capacity for people to lodge proceedings by legislation. It is up to us to act as we see morally fit. It is a shame that contingency fees have led to an increase in tenuous claims but this has to be balanced against the fact that contingency fees allow poor(er) people to make civil claims. The parents in this case (at least) claim that they only proceeded to court so as to access documents that they had been denied by the Parks Service. It is important to note that outrageous claims often make headlines when they are lodged but the decision to throw them out does not necessarily get as much media attention.
